TERMS AND CONDITIONS OF SALE

The following terms and conditions of sale are applicable to the offer and sale of The Lab Room products through the website www.thelabroom.com, an e-commerce website accessible via internet and open to any net user.

At our online shop users may browse the different web pages without needing to register. When the user wishes to make a purchase they must register to complete the process. To register, the customer must supply their personal details, ID and delivery information, as well as agreeing to the contract and privacy conditions. In accordance with the stipulations of article five of Spanish Organic Law 15/1999, you are informed that the data gathered through these forms will be added to the The Lab Room data file. The purpose of the information collected will be to process your purchase orders, plus carrying on any commercial activity. When a customer registers as a user they authorise The Lab Room to use the said information for commercial purposes such as sending out brand newsletters and offers, though the customer may deregister whenever they want without any problem.
Delivery Restrictions

In the case of products sent to international addresses, bear in mind that the instructions and warnings concerning the product may not be available in the language of the destination country; the products (and the material accompanying them) may not have been designed in accordance with the regulations, specifications or labelling requirements of the destination country. You are responsible for legally importing the product into the destination country. When you place an order at www.The Lab Room.com, the addressee will be the named importer, and must abide by all the laws and regulations of the destination country.

Tariffs, Duties and Taxes

You are responsible for ensuring that the product can be legally imported into the destination country. When you place an order at www.thelabroom.com, the addressee will be the named importer, and must abide by all the laws and regulations of the destination country. Orders sent outside Spain may be subject to import duties and customs tariffs on arrival in the destination country. Any additional charge for customs clearance shall be borne by the addressee; we have no control over such charges and cannot predict their amount. Customs policies vary widely from one country to another. To obtain further information, contact your local customs office. Should customs clearance procedures be necessary, this may lead to delays in addition to our planned delivery times.

Privacy

Your privacy is important to us and we know that it is important for you to know how information concerning your order will be used or shared. We wish to inform all our international customers and those of our customers who send orders to international addresses that cross-border deliveries may be opened and inspected by customs authorities. We will supply certain information about the order, the delivery address and the product to our international carriers and they in turn may pass on this information to the customs authorities in order to facilitate customs clearance and comply with local legislation.

Placing Orders

To place an order, the customer must enter the number of The Lab Room products they wish to buy by selecting the “add to basket” option and these will be included immediately in the shopping basket represented by an The Lab Room bag. The customer may correct any error in the data entered at any time, change the contents of their shopping basket or cancel the order before effecting payment. In placing the order, the customer agrees to and declares they have read all the instructions shown and agrees to these Terms and Conditions in their entirety. Soon after placing the order the customer will receive an e-mail confirming reception of the order. This document will have the status of a contract for the purposes of the stipulations of article 23 of Spanish Law 34/2002. Consequently, the parties agree that the contract shall be considered to have been entered into at the company’s place of business. To redeem a promotional code, the customer must enter their code in the box during the purchase process. Promotional codes are case-sensitive and must always be entered exactly as they appear.

Products

The shop window of products presented by The Lab Room in the different sections of its website is subject to change of any kind or discontinuation of its products without prior notice, affecting both their features and their price, but in any case the conditions of sale in force at the time of purchase will continue to apply. Each product will have a data file specifying its features, how to use it, ingredients and related products. We undertake to keep a stock of all the products shown on the website. Furthermore, we will take reasonable precautions to ensure that all details, descriptions and pictures of products appearing in our shop are complete, reliable, up to date and error-free. The products described on the website and any samples thereof which might be sent to the customer are for personal use only. Customers may not sell or resell the said products and samples. We reserve the right to cancel or reduce the quantity of products or samples to be delivered to the customer if this represents an infringement of these Terms and Conditions.

Delivery Costs and Shipping Conditions and Times

The Lab Room will automatically add the pertinent delivery costs to your purchases depending on the means of shipment chosen. In the first step of the order confirmation procedure you will be able to see the delivery/shipping costs which apply to your country.

Completing Payment Information

The next step is to choose how to effect payment. All orders placed through the The Lab Room online shop must be paid for in advance. 
The customer can pay for The Lab Room products using the following credit cards: Visa, MasterCard, Maestro. They can also pay through a PayPal account using their SSL encryption services.

Returns

Returns will only be accepted in the following cases:

– Defective product.

– Changed texture or fragrance.

– Broken bottle.

If the customer wishes to return articles for any of the above reasons they can do so in their original packaging within 7 working days of receiving the order, in accordance with article 44 of the Spanish retail trade regulation act, Law 7/1996 of 15th January 1996 as amended by Law 47/2002 of 19th December 2002. To do this they must follow the steps below:

- The customer must send a complaint using our form or send an e-mail to info@thelabroom.com within a maximum of 24 hours of receiving the order.

The purchaser shall have seven working days in which to return the product. The customer must pay the direct cost of returning the product. In the event that the complaint is made within 24 hours of reception, the cost will be borne by The Lab Room.

After checking the returned products, The Lab Room will if appropriate refund the cost of the returned order plus the costs of returning it. Products must be returned as promptly as possible, and in any case within a maximum of thirty days after withdrawal.

Refunds will be made through the same form of payment and bank account and will only be made through the credit card used in the purchase process.
No complaints or returns will be accepted once the periods specified above have elapsed.

Under no circumstances will we accept returns due to errors in the order placed by the customer, as we consider that they check and agree to the products when they buy them.
